Booking and Cancellation

Booking

When you book a ride with Indus Cab, you will receive a confirmation via email or SMS. The confirmation will include the details of your ride, including the estimated fare.

Cancellation

You may cancel your booking within a specified period without incurring a cancellation fee. If you cancel your booking outside of this period, you may be charged a cancellation fee. The specific terms and fees associated with cancellations will be provided at the time of booking.

Payment

Payment Methods

We accept various payment methods, including credit/debit cards and digital wallets. You agree to provide accurate and complete payment information. By providing payment information, you authorize us to charge the applicable fees to your chosen payment method.

Payment Terms

Payment for the Service is due immediately upon completion of the ride. We will automatically charge the fare to your chosen payment method. If the payment method is invalid or the transaction is declined, we may charge you any applicable fees and attempt to process the payment again.

Fares and Fees

Fare Calculation

Fares are calculated based on the distance traveled and the time taken for the ride. Additional charges may apply for services such as waiting time, tolls, and other surcharges. The estimated fare provided at the time of booking is subject to change based on actual ride conditions.

Fees

Additional fees may apply for cancellations, no-shows, and other circumstances. These fees will be clearly communicated at the time of booking.

User Conduct

Prohibited Conduct

You agree not to engage in any of the following activities while using our Service:

• Illegal Activities: Engaging in activities that violate any applicable law or regulation.
• Harassment: Harassing, threatening, or harming other users or drivers.
• Fraud: Providing false or misleading information, or engaging in fraudulent activities.
• Interference: Interfering with the operation of the Service or the network used to provide the Service.

Driver Conduct

Our drivers are expected to adhere to high standards of conduct. If you experience any issues with a driver, please report the incident to us immediately.

Liability

Disclaimer of Warranties

Our Service is provided “as is” and “as available.” We disclaim all warranties, whether express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability for all claims related to the Service exceed the amount paid by you to us for the specific service in question.

You agree to indemnify and hold harmless Indus Cab, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Termination

We may terminate or suspend your access to our Service, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting our customer support.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Indus Cab operates, without regard to its conflict of law provisions. Any dispute arising from these Terms or the use of the Service shall be resolved exclusively in the courts located within that jurisdiction.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the extent necessary to make it valid and enforceable.

These Terms constitute the entire agreement between you and Indus Cab regarding the use of the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding the use of the Service.

Miscellaneous

• No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights under these Terms to any third party without notice to you.
• Force Majeure: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
